प्रमुख सचिव गृह ताबड़तोड़ तबादला याचिका- फैसला सुरक्षित  

आईपीएस अफसर अमिताभ ठाकुर द्वारा पिछले कुछ महीनों में उत्तर प्रदेश सरकार द्वारा प्रमुख सचिव पद पर किये गए ताबड़तोड़ तबादलों के खिलाफ दायर याचिका में केन्द्रीय प्रशासनिक अधिकरण (कैट) के लखनऊ बेंच ने आज मामले की पोषणीयता पर अपना फैसला सुरक्षित कर लिया.  

याचिका के अनुसार 15 अक्टूबर 2013 से अब तक 4 अफसर इस पद पर तैनात हो चुके हैं और इनमे कुछ अफसरों के तबादले मात्र कुछ दिनों में कर दिए गए थे, जो आईएएस कैडर नियम 2014 के नियम 7 के सर्वथा विपरीत है जिसमे आईएएस अफसरों के लिए एक स्थान पर कम से कम 2 साल की तैनाती और केवल विशेष स्थितियों में ही कारण बताते हुए इससे कम समय में तबादला किये जाने की व्यवस्था की गयी है.

उत्तर प्रदेश सरकार के अधिवक्ता सुदीप सेठ ने यह कहते हुए विरोध किया कि श्री ठाकुर इस मामले में प्रभावित व्यक्ति नहीं हैं क्योंकि उनका ट्रांसफर नहीं किया गया है जबकि श्री ठाकुर ने यह कहा कि प्रमुख सचिव गृह के हो रहे लगातार तबादलों के कारण एक आईपीएस अफसर के रूप में उनके तमाम सेवा सम्बंधित मामलों पर प्रतिकूल प्रभाव पड़ रहा है.

प्रशासनिक सदस्य जयति चंद्रा की बेंच ने दोनों पक्षों की बात सुन कर अपना आदेश सुरक्षित कर लिया.

The Central Administrative Tribunal (CAT), Lucknow bench  today reserved its order regarding maintainability  of the petition filed by IPS officer Amitabh Thakur against the rapid transfer of Principal Secretaries of Home department by the UP government during the last few months.

The petition says that since 15 October 2013, 4 officers have come to this post and officers have been transferred even within a few days, which is completely against Rule 7 of the IAS Cadre Rules 2014 which stipulates a minimum term of 2 years for all IAS officers and transfer before this period only in special circumstances, after having specified the reason for doing so.

Sudip Seth, counsel for UP Government opposed the petition by saying that Sri Thakur is not an affected party because he has not been transferred while Sri Thakur said that the frequent transfer of Principal Secretary Home is adversely affecting his service related matters as an IPS officer.

Administrative Member Jayati Chandra reserved her order after hearing both the parties.
