PIL challenges appointment of ad-hoc Advocate General

A PIL has filed in Allahabad High Court, Lucknow Bench by the social organization People’s Forum challenging the appointment of C B Yadav, additional Advocate General (AAG) as ad-hoc Advocate General (AG) as being unconstitutional

As per Dr Nutan Thakur, convener, People’s Forum, the Constitution does not envisage the post of temporary AG and this appointment is also against the Supreme Court order in M T Khan vs AP government which says that AAG cannot be given any statutory or constitutional responsibility of AG, as has been done here.   

Hence calling this appointment as blatantly unconstitutional, the petition seeks immediate removal of Sri Yadav from this post and formation of a Judicial Committee to enquire and fix responsibility for such illegal appointment.

कार्यवाहक महाधिवक्ता की नियुक्ति को चुनौती  

सामाजिक संगठन पीपल्स फोरम ने आज सी बी यादव, अपर महाधिवक्ता को उत्तर प्रदेश का कार्यवाहक महाधिवक्ता बनाए जाने के आदेश को असंवैधानिक बताते हुए इसे निरस्त करने हेतु इलाहाबाद हाई कोर्ट की लखनऊ बेंच में पीआईएल दायर किया है.

पीपल्स फोरम की कन्वेनर डॉ नूतन ठाकुर के अनुसार संविधान में कार्यवाहक महाधिवक्ता की कोई व्यवस्था नहीं है और सुप्रीम कोर्ट ने एम टी खान बनाम आंध्र प्रदेश सरकार में यह स्पष्ट कर दिया था कि अपर महाधिवक्ता को महाधिवक्ता के संवैधानिक दायित्व नहीं दिए जा सकते हैं, इसके बावजूद यहाँ ऐसा किया गया है.

अतः इस नियुक्ति को प्रथमद्रष्टया असंवैधानिक बताते हुए याचिका में श्री यादव को तत्काल पद से हटाये जाने और एक न्यायिक आयोग बना कर उनकी इस विधि-विरुद्ध तैनाती के लिए जिम्मेदार लोगों के खिलाफ कार्यवाही करने की मांग की गयी है.
