PIL challenges rampant IAS, IPS transfers in UP
A PIL has filed in Allahabad High Court, Lucknow Bench by the social organization People’s Forum challenging the extremely rampant transfer of IAS and IPS officers in UP against the rules.
As per Dr Nutan Thakur, convener, People’s Forum, the IAS Cadre Amendment Rules 2014 and IPS Cadre Amendment Rules 2014 promulgated on 28 January 2014 stipulate a minimum term of 2 years for all IAS and IPS officers and only in special circumstances an officer can be transferred before this period, after having specified the reason for doing so.
Against this the petition cites dozen examples of rapid transfers including that of Aditi Singh posted as Additional Managing Director UPSRTC on 08 February, DM Rae Bareli on 14 February, waiting list on 09 June and Special Secretary, APC branch on 10 June and Aparna U posted as DM Shahjahanpur on 30 March, Special Secretary, Revenue on 03 July and Special Secretary Irrigation on 17 July.
Similarly among IPS officers the petition presents among others examples of Nitin Tiwari made SSP Muzaffarnagar on 04 March 2013, SSP Ghaziabad on 18 July 2013, SSP Bulandshahr on 26 March 2014 and SSP Mathura on 07 June and Dharamveer attached with DGP office on 07 June 2012, SP Jaunpur on 07 November 2012, SSP Aligarh on 25 July 20134, DGP office on 26 March 2014, Commandant, 49th PAC on 12 April, SP Auraiya on 07 June and SSP Moradabad on 16 June.
Based on large number of such examples, the petition seeks enquiry and action against such senior officers like Chief Secretary, Chairman, Board of Revenue and others who are members of the Civil Service Board responsible for these transfers and formation of appropriate mechanisms to ensure that the provisions related to transfer of IAS and IPS officers is fully adhered.

सामाजिक संगठन पीपल्स फोरम ने उत्तर प्रदेश में नियमों के विपरीत आईएएस और आईपीएस अफसरों के आयेदिन हो रहे तबादलों के खिलाफ इलाहाबाद हाई कोर्ट की लखनऊ बेंच में पीआईएल दायर किया है.
पीपल्स फोरम की कन्वेनर डॉ नूतन ठाकुर के अनुसार 28 जनवरी 2014 को लागू हुए आईएएस कैडर संशोधन नियम 2014 और आईपीएस कैडर संशोधन नियम 2014 के अनुसार आईएएस तथा आईपीएस अफसरों के लिए एक स्थान पर कम से कम 2 साल की तैनाती की व्यवस्था की गयी है और केवल विशेष स्थितियों में ही कारण बताते हुए इससे कम समय में तबादला किया जा सकता है.
इसके विपरीत याचिका में दर्जनों आईएएस अफसर के उदाहरण दिए गए हैं जहां बहुत तेजी से तबादले हुए हैं. अदिति सिंह 08 फ़रवरी को यूपी परिवहन निगम में अतिरिक्त एमडी, 14 फ़रवरी को डीएम रायबरेली, 09 जून को प्रतीक्षा पर और 10 जून को विशेष सचिव, एपीसी ब्रांच तैनात हुईं. अपर्णा यू 30 मार्च को डीएम शाहजहांपुर, 03 जुलाई को विशेष सचिव राजस्व और 17 जुलाई को विशेष सचिव सिंचाई बनायी गयीं.
आईपीएस अफसरों में अन्य उदाहरण में नितिन तिवारी 04 मार्च 2013 को मुज़फ्फरनगर, 18 जुलाई 2013 को गाज़ियाबाद, 26 मार्च 2014 को बुलंदशहर, 07 जून को मथुरा के एसएसपी और धरमवीर 07 जून 2012 को डीजीपी ऑफिस, 07 नवम्बर 2012 को एसपी जौनपुर, 25 जुलाई 2013 को एसएसपी अलीगढ, 26 मार्च 2014 को डीजीपी ऑफिस, 12 अप्रैल को कमांडेंट 49 वाहिनी पीएसी, 07 जून को एसपी औरैया और 16 जून को एसएसपी मुरादाबाद बनाए गए.
इन तमाम उदाहरणों के आधार पर याचिका में इस प्रकार नियमविरुद्ध तबादलों के लिए जिम्मेदार मुख्य सचिव, अध्यक्ष रेवेब्यु बोर्ड जैसे सिविल सेवा बोर्ड के वरिष्ठ अफसरों के खिलाफ जांच कर कार्यवाही करने और भविष्य में इस प्रकार की स्थिति रोकने के लिए कार्ययोजना बनाए जाने की प्रार्थना की गयी है.
